Consent to Electronic Records and Signatures

Preamble

By signing this Agreement electronically, you agree to receive records and conduct this transaction electronically. This disclosure explains your rights under the federal Electronic Signatures in Global and National Commerce Act (ESIGN) and the Washington Electronic Authentication Act.

Scope of Your Consent

Your consent to do business electronically with Cosmetics Growth covers each of the following categories of records (15 U.S.C. § 7001(c)(1)(B)(iii)):

  1. The Client Services Agreement (the "Agreement") presented to you for signature, including all schedules and exhibits, and the Business Associate Agreement attached as Exhibit A.
  2. Future invoices and billing notices delivered under Section 4 of the Agreement.
  3. Future amendments and notices delivered under Section 15.4 of the Agreement.
  4. The monthly performance reports referenced in Sections 3.5(f) and 7.4 of the Agreement.

This consent does not extend to any record outside the categories above. If we ever need to deliver a different category of record electronically, we will ask for your consent first.

Hardware and Software Requirements

To access, sign, and retain the records covered by this consent, you need (15 U.S.C. § 7001(c)(1)(C)(i)):

  • A JavaScript-enabled web browser released within the last 24 months. Supported browsers: Chrome 120 or later, Safari 17 or later, Firefox 121 or later, and Microsoft Edge 120 or later.
  • The ability to receive email at the address you provided to us.
  • The ability to open PDF files using a current PDF reader (Adobe Reader, Apple Preview, the built-in PDF viewer in your browser, or an equivalent reader).
  • Approximately 5 megabytes of free local storage to download the executed copy of the Agreement and the audit certificate that accompanies it.

Confirmation You Can Access These Records

Before the signature pad enables, the signing system will ask you to check a box that says "I confirm I can open PDF attachments at [your email]." You will see this prompt on the same page as this disclosure (15 U.S.C. § 7001(c)(1)(C)(ii)). If you cannot open PDF attachments at the email address on file, do not check the box and do not sign. Email dan@cosmeticsgrowth.com so we can resolve the access issue before you sign.

If These Requirements Change

If at any time the hardware or software requirements above change in a way that creates a material risk you cannot access future records, we will notify you at your last-provided email address. You may then withdraw your consent without penalty by replying to that notice (15 U.S.C. § 7001(c)(1)(D)).

Your Right to Receive Paper Copies

You may request a paper copy of the executed Agreement and any related electronic record at any time, at no charge to you (15 U.S.C. § 7001(c)(1)(B)(i)). To request a paper copy, email dan@cosmeticsgrowth.com with the subject line "Paper Copy Request" and your practice name, or mail a written request to:

We will mail a paper copy to the practice address on file within ten (10) business days of receiving your request.

Your Right to Withdraw Consent

You may withdraw your consent at any time by emailing dan@cosmeticsgrowth.com with the subject line "Withdraw electronic consent." Withdrawal of consent is prospective only: future records will be sent to your address of record on paper, which may delay invoicing and required notices. The executed Agreement and any records retained at the time of withdrawal remain valid and binding. There is no fee or penalty for withdrawing consent (15 U.S.C. § 7001(c)(1)(B)(i)–(ii)).

Updating Your Contact Information

To update the email address or mailing address on file, email dan@cosmeticsgrowth.com from your current address with the new address you would like us to use. We will confirm the update within two (2) business days. Until you receive that confirmation, the address previously on file remains the address of record.

Identity Verification at Signing

To protect both parties, the signing system will ask you to independently confirm three details about your practice: your Employer Identification Number (EIN), your practice phone number, and the city of your practice's primary address. These are details only an authorized signer would readily know. We compare your inputs to information already on file by hashing them locally before comparison; we do not display your inputs back to anyone, and we do not learn anything about you that we did not already have on file. After three failed attempts the signing link locks for security, and you can have it reset by emailing dan@cosmeticsgrowth.com.

Signature Image and Audit Trail

When you sign, the system captures:

  • The signature image you draw on the signing pad.
  • An audit trail of every view event and sign event tied to your signing link, with timestamps in Coordinated Universal Time (UTC) and the originating IP address.
  • The browser-reported time zone in which you signed.

After both you and Cosmetics Growth sign, the system externally timestamps the executed PDF using two independent Time Stamping Authorities, FreeTSA and DigiCert, under the RFC 3161 standard. Three independent custodial copies of the executed PDF are stored: one on Cosmetics Growth's primary system of record, one in a Cosmetics Growth admin mailbox, and one in an off-site personal mailbox controlled by Cosmetics Growth's principal. The audit certificate that accompanies the executed Agreement reproduces the audit trail and the external timestamps.

Effective Date and Updates

This disclosure was last revised on the date shown at the top of this page. The current version always lives at https://sign.cosmeticsgrowth.com/legal/e-sign-consent. If we materially change this disclosure, we will email you at your address of record before the change takes effect. You may withdraw your consent under the section above if you do not agree to a material change.
